By using the products and services of APU Software, LLC (“APU”, “we”, “us”, “our”), including our audio plug-ins (the “Products”), you agree to be bound by the following terms and conditions:
Product and Service Description
Our products and services include various audio plug-ins, related software, updates, and support. The Products are provided “as is” and we do not make any representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the Products or the information, products, services, or related graphics contained in the Products for any purpose. Any reliance you place on such information is therefore strictly at your own risk.
License
We grant you a personal, non-transferable, non-exclusive license to use the Products in accordance with the applicable End User License Agreement (EULA) for each Product.
Agreement to EULA
For paid plug-ins, by completing the purchase, you agree to the terms and conditions of the Paid EULA, which can be found at https://apu.software/eula-paid/. For free plug-ins, you agree to the terms and conditions of the Free EULA, which can be found at https://apu.software/eula-free/.
Payment and Refunds
All payments for our products and services are processed by Stripe and are non-refundable.
Limitation of Liability
In no event shall APU be liable for any damages whatsoever, including, but not limited to, direct, indirect, special, incidental, or consequential damages, arising out of or in connection with the use or inability to use the Products.
Jurisdiction and Dispute Resolution
This TOS shall be governed by and construed in accordance with the laws of the State of Ohio, without giving effect to any principles of conflicts of law. Any dispute arising under or in connection with this TOS shall be resolved in accordance with the laws of the State of Ohio.
Agreement
By using our products and services, you agree to these TOS, our privacy policy (https://apu.software/privacy-policy), the applicable EULA for each Product, and you acknowledge that you have read and understand them.
